TERMS AND CONDITIONS

Eros Bliss is an interactive website (“Website”) developed by A’s Amazing Pte Ltd (“Company”) which provides online sex-coaching courses to its customers (“Users”).

By accessing and using any part of this website, you irrevocably and unconditionally agree and accept to be legally bound by these Terms which shall be governed and construed in accordance with laws of Singapore. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THIS WEBSITE.

In case of any violation of these Terms, the Company reserves the right to seek all remedies available under the law and in equity for such violations. These Terms apply to all visits to the Website, both now and in the future.

The Company reserves the right to change these Terms from time to time at its sole and absolute discretion.

All changes will be posted on this page, and your use of this website after such changes have been posted will constitute your agreement to the modified Terms and all of the changes. You should therefore read this page carefully each time you visit this website.

These terms and conditions “Terms” govern our relationship with Users of Eros Bliss and others who interact with Eros Bliss.

1. DEFINITIONS AND INTERPRETATION

Unless the context otherwise requires, the following expressions shall have the following meanings in these Terms:-

“Password” refers to the valid password that a User who has an account with Eros Bliss and may used in conjunction with the Username to access Eros Bliss;

“Personal Data” has the meaning ascribed thereto in the PDPA and includes your name, e-mail address, billing address, shipping address, phone number and credit card information;

“PDPA” means the Personal Data Protection Act 2012 of Singapore;

“Trademarks” means the trademarks, service marks, trade names and logos used and displayed on the Eros Bliss interactive website;

“User(s)” means a person (regardless of whether an Active User or Passive User) who uses the Website; and

“Username” refers to the unique login identification name or code which identifies a Customer who has an account with Eros Bliss.

2. LICENCE

The Company grants you a worldwide, non-exclusive, royalty-free revocable licence to use Eros Bliss interactive website for your personal, non-commercial use in accordance with these Terms.

3. INTELLECTUAL PROPERTY

3.1 All copyright and other intellectual property rights in all text, images, sound, video, software and other materials on the Website are owned by the Company or are included with the permission of the relevant owner.

3.2 We grant you a non-exclusive, non-transferable, revocable license to access and use our Website to watch our video tutorials and website materials (“Videos”) strictly in accordance with this Agreement. Your use of our Website and Videos are solely for internal, personal, non-commercial purposes.

3.3 Except as otherwise provided, the contents of the Website including but not limited to the Videos shall not be copied, downloaded, “ripped”, reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way, without the prior written permission of the Company.

3.4 You are permitted to browse the Website and you may view the selected and paid videos provided in this website for non-commercial, information and personal purposes only. No reproduction of any part of the Website may be sold or distributed for commercial gain nor shall it be modified or incorporated in any other work, publication or site, whether in hard copy or electronic format, including posting to any other site unless you receive specific prior written consent from the Company. Save as aforesaid, no other licence or right is granted.

3.5 Modification of any of Videos or use of the Videos for any other purpose will be a violation of the Company’s copyright and other intellectual property rights. Graphics and images on this website are protected by copyright and may not be reproduced or appropriated in any manner without the prior written permission of their respective copyright owners.

3.6 The design and layout of this website is protected by intellectual property and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound, image or search engine from this website may be copied or transmitted unless with the prior express permission of the Company.

3.7 Some Videos contain nudity and sex acts. However, as Eros Bliss is in the business of providing sex-coaching courses, the Videos shall not be construed as pornography and/or obscene films.

4. REGISTRATION

4.1 To access the Website and the Videos, you may be asked to provide certain registration details or other information including email addresses, contact details and password (“Personal Information”). In connection with the foregoing, you warrant and represent to the Company that such Personal Information is accurate and up to date.

4.2 It is a condition of your use of the Website that all the information you provide on the Website is correct, current, and complete. You agree that all information you provide to register with this Website or otherwise, including but not limited to through the use of any interactive features on the Website, is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

4.3 If you choose, or are provided with, a user name, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Website or portions of it using your user name, password or other security information. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

4.4 We have the right to disable any user name, password or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Use.

4.5 By registering an account with Eros Bliss, you also agree to the following:

(a) you will not provide any false personal information on Eros Bliss, or create an account for anyone other than yourself without permission;

(b) you will not create more than one personal account;

(d) you will not use Eros Bliss if you are under 21;

(e) you will keep your Personal Information accurate and up-to-date;

(f) you will not share your password, let anyone else access your account, or do anything else that might jeopardise the security of your account;

(g) you will not transfer your account to anyone without first getting our written consent; and

(h) if you select a Username or similar identifier for your account, we reserve the right to remove or reclaim it if we believe it is appropriate.

Payments and refunds

4.6 The fee for each course (the “Fee”) must be paid in full at the time of registration for the relevant course. Registration for each course is not complete until the Company has received such full payment of the Fee. Unless the Company cancels a course after you have paid, all fees paid are not refundable regardless of whether you have utilised the course and/or watched the Videos.

Duration

4.7 You may access and view the Videos in each course as many times as you wish save that the entire duration of access is three (3) months and you access will be disabled by the Company upon such expiry.

5. PERSONAL DATA

5.1 We collect the Personal Information you provide when you use our services, including when you sign up for an account, create or share Content and Information, and message or communicate with other Users.

5.2 You agree that we may collect, use and disclose your Personal Information, as provided in the registration section, for the purposes of processing your application for registration with Eros Bliss and the administration of your Eros Bliss account and unless you inform us otherwise, by registering for an Eros Bliss account you consent to us to sending you information about Third Party Vendors.

5.3 We also collect information about how you use our services, such as the types of content you view or engage with or the frequency and duration of your activities.

5.4 We also collect Content and Information that other people provide when they use our services, including searching for information about you and or your Content and Information, such as when they share a video of you, access details of your video, send a message to you, or upload, sync or import your Content and Information.

5.5 We collect information about the people and groups you are connected to and how you interact with them, such as the people you communicate with the most or the groups you like to share with.

5.6 If you use our services for purchases or financial transactions (for example when you purchase courses on Eros Bliss), we collect information about the purchase or transaction. This includes your payment information, such as your credit or debit card number and other card information, and other account and authentication information, as well as billing, shipping and contact details.

5.7 We collect information from or about the computers, phones, or other devices where you install or access our services, depending on the permissions you have granted. We may associate the information we collect from your different devices, which help us provide consistent services across your devices. Here are some examples of the device information we collect:

(a) attributes such as the operating system, hardware version, device settings, file and software names and types, battery and signal strength, and device identifiers;

(b) device locations, including specific geographic locations, such as through GPS, Bluetooth, or WiFi signals; and

(c) connection information such as the name of your mobile operator or ISP, browser type, language and time zone, mobile phone number and IP address.

5.8 We receive information about you and your activities on and off Eros Bliss from third-party partners, such as information from a partner when we jointly offer services, collaborations or from an advertiser about your experiences or interactions with them.

6. UNDERTAKINGS

By using Eros Bliss, you agree not to do any of the following:-

(a) you will not upload viruses or other malicious code onto Eros Bliss;

(b) you will not solicit login information or access an account belonging to someone else;

(d) you will not do anything that could disable, overburden, or impair the proper working or appearance of Eros Bliss, such as a denial of service attack or interference with Eros Bliss functionality; and

(e) you will not facilitate or encourage any violation of these Terms.

7. LINKS TO THIRD PARTY WEBSITE

7.1 The Company sources for Users via online platforms including but not limited to targeted ads on Google and YouTube. The Company may also reach out to potential Users on social media and collaborations with third parties.

7.2 As such, Eros Bliss may contains links to websites operated by third parties (“Third Party Websites“).

7.3 Eros Bliss may monetise some of these links through the use of third party affiliate programmes. Notwithstanding such affiliate programmes, Eros Bliss does not have any influence or control over any such Third Party Websites and, unless otherwise stated, is not responsible for and does not endorse any Third Party Websites or their availability or contents.

8. LIMITATION OF LIABILITY

8.1 The use of Eros Bliss and Videos are at the User’s own risk. The information and Videos presented on Eros Bliss is provided “as is” and “as available,” without representation or warranty of any kind whatsoever. Any representation or warranty that might be otherwise implied is expressly disclaimed.

8.2 The content and Videos on our website are not intended to be construed as advice. You must not rely on any of the content of our Website for any purposes whatsoever, and you must seek your own independent professional advice before deciding to take any course of action on the basis, whether in whole or in part, of any of the content available on our website at any time.

8.3 Without prejudice to the generality of the foregoing, we do not warrant:

(a) the accuracy, timeliness, adequacy, commercial value or completeness of all data and/or information contained in the Website or the Videos;

(b) that the Website or the Videos will be provided uninterrupted, secure or free from errors or omissions, or that any identified defect will be corrected;

(c) that the Website or the Videos are free from any computer virus or other malicious, destructive or corrupting code, agent, program or macros; and

(d) the security of any information transmitted by you or to you through the Website or the Services, and you accept the risk that any information transmitted or received through the Website or the Videos may be accessed by unauthorised third parties and/or disclosed by us or our officers, employees or agents to third parties purporting to be you or purporting to act under your authority. Transmissions over the Internet and electronic mail may be subject to interruption, transmission blackout, delayed transmission due to internet traffic or incorrect data transmission due to the public nature of the Internet.

8.4 The Company expressly disclaims:-

(a) all liability whatsoever to the extent permitted by law whether arising in contract, tort or otherwise in relation to the use of Eros Bliss; and

(b) all implied warranties, terms and conditions relating to Eros Bliss (whether implied by statute or common law) including without limitation any warranty, term or condition as to accuracy, completeness, satisfactory quality, performance, fitness for purpose or any special purpose, non-infringement and information accuracy.

8.5 In particular but without prejudice to the foregoing, we accept no responsibility for any technical failure of the internet, data transmitted through Eros Bliss or the failure of Eros Bliss or any damage or injury to Users of Eros Bliss or their equipment as a result of or relating to their use of Eros Bliss.

8.6 The Company will not be liable, in contract, tort (including, without limitation, negligence), under statute or otherwise, as a result of or in connection with Eros Bliss, for any: (i) economic loss (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings); or (ii) loss of goodwill or reputation; or (iii) special or indirect or consequential loss.

8.7 For the avoidance of doubt, in the event the Company is liable to you directly or indirectly in relation to Eros Bliss, the Company’s liability shall be limited to the amount paid by you in any expenditure incurred by you through the use of Eros Bliss.

9. GENERAL

Amendments to Terms

Eros Bliss reserves the right to update these Terms from time to time. If it does so, the updated version will be effective immediately, and the current Terms are available through a link in Eros Bliss to this page. You are responsible for regularly reviewing these Terms so that you are aware of any changes to them and you will be bound by the new policy upon your continued use of Eros Bliss. No other variation to these Terms shall be effective unless in writing and signed by an authorised representative on behalf of Eros Bliss.

Indemnity

You agree to indemnify Eros Bliss in full and on demand from and against any damages, losses, liabilities, claims, actions, proceedings, costs (including legal costs on a full indemnity basis as well after as before judgment) and expenses which Eros Bliss may suffer or incur relating to, in connection with, arising from your use of Eros Bliss.

Termination

If you violate any of the Terms, or otherwise create risk or possible legal exposure for us, we can stop providing all or part of Eros Bliss to you. We will notify you by email or at the next time you attempt to access your account.

No Waiver

Any failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Eros Bliss in writing.

Governing law

These Terms shall be governed by and construed in accordance with Singapore law and you agree to submit to the exclusive jurisdiction of the Singapore Courts.
